1. Acceptance of Terms

By downloading, installing, accessing, or using Conquest Arcade, available through the Apple App Store and at conquestarcade.com (the "Platform" or "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and Conquest Labs LLC, with its registered office at 2810 North Church Street, Wilmington, DE 19802, USA (together with its affiliates, partners, representatives, employees, and contractors, "Conquest," "we," "our," or "us"). Your continued use of the Platform following any modification to these Terms constitutes your acceptance of those modifications. The Conquest Arcade Privacy Policy is incorporated by reference.

2. Eligibility

You must be at least 18 years of age (21 years of age in states where required), or the age of majority in your jurisdiction (whichever is greater), to create an account or to participate in any paid feature involving real monetary value. The Platform is offered to residents of the United States located in jurisdictions where real-money skill gaming is lawful and not restricted. You must be physically located in a jurisdiction in which we offer paid play.

We use geolocation tools to verify eligibility, enforced on our servers on a fail-closed basis. The use of VPNs, proxies, or other tools to mask your location or circumvent these checks is prohibited and is grounds for immediate account termination and forfeiture of balances. Your age and identity are verified through our identity-verification process (see Section 8) before you can withdraw funds. By creating an account or using the Platform, you represent and warrant that you meet each of these eligibility requirements. We reserve the right to request proof of age, residency, or location at any time and to suspend or terminate accounts we reasonably believe are operated by individuals who do not meet these requirements. You are responsible for ensuring that your use of the Platform complies with all laws applicable in your jurisdiction. Free Practice mode remains available regardless of age eligibility or location.

3. Account Registration

On iOS, accounts are created and authenticated using Sign in with Apple. To access paid features, you must complete onboarding. You agree to:

Provide accurate, current, and complete information during registration and identity verification, and keep it updated.
Maintain only one account per person. Multiple accounts ("multi-accounting") are prohibited and will result in immediate termination of all associated accounts.
Keep the credentials of the Apple ID linked to your account confidential and not share them with any third party.
Notify us immediately at team@conquestarcade.com if you become aware of any unauthorized use of your account.

You are solely responsible for all activities that occur under your account. Conquest is not liable for any losses arising from unauthorized access to your account resulting from your failure to safeguard your credentials.

4. Platform Description & Balances

Conquest Arcade is a mobile arcade offering skill-based games that may be played for free or, where eligible, in competitive matches for virtual currency and cash prizes. The available games and modes may change from time to time at our discretion. Match outcomes are determined by player performance and adjudicated on our servers.

The Platform maintains three distinct balances, which are not interchangeable:

(a) Gems — an in-App virtual currency earned through gameplay (such as daily rewards, match victories, referrals, and rewarded ads) and used to enter Gem matches. Gems cannot be purchased and have no monetary value; they cannot be exchanged, transferred, or redeemed for cash, goods, or any other currency, inside or outside the App.

(b) Cash — prepaid on-platform credit funded by your deposits (USD 1.00 = 1 Cash), spendable only on cash-match entry within the App. Cash is non-refundable and non-withdrawable, holds no cash value outside the App, and is not a stored-value or deposit account.

(c) Withdrawable Cash — credit obtained exclusively from winning cash matches. It may be used to enter further cash matches or withdrawn, subject to the conditions in Sections 8 and 9.

Each cash-match entry fee is drawn from your Cash and Withdrawable Cash balances according to an internal allocation ratio that we may adjust from time to time.

5. Skill-Based Competition; Not Gambling

Conquest Arcade contests are games of skill. Outcomes are determined predominantly by each player's skill, reflexes, and strategy — not by chance. Players compete against other players or against a fixed skill target, not against the house, and no wager is placed on a random event. Conquest is not a sportsbook, casino, or lottery. Because state laws governing paid skill contests differ, paid participation is offered only where lawful, and it remains your responsibility to ensure paid participation is legal in your location before you deposit or enter a paid match.

6. Paid Matches, Entry Fees & Prizes

Paid competition is offered in two currencies. In Gem matches, you pay a Gem entry fee and the winner receives a Gem prize. In Cash matches, you set a custom cash wager up to a per-match maximum we set; the entry fee and prize are derived from your chosen win amount and are displayed before you enter, and cash-match prizes are credited to your Withdrawable Cash balance. Entry fees, prizes, tiers, and limits may change from time to time and are always shown to you before you commit to a match. The following rules apply to all paid matches:

The entry fee is deducted the moment a paid match begins and is non-refundable once deducted, except as stated below.
If you do not win, your entry fee is forfeited in full. There are no partial refunds.
Match results are determined and validated server-side; our servers are the authoritative record. Any attempt to manipulate, intercept, or falsify match data is cheating and will result in termination and forfeiture.
In player-versus-player matches, both players compete independently and the higher qualifying score wins. A tie (draw) refunds both players' entry fees with no rake.
If you abandon, quit, disconnect, or fail to submit a score in a match against another player, it may be resolved as a forfeit and a loss, and your opponent may be awarded the prize.
We may cancel a match and refund entry fees at our sole discretion where a technical fault, server error, or outage affects match integrity.

7. Deposits & Payments

No custody of funds; nature of "deposits." Although we use the word "deposit" for convenience, Conquest Labs LLC does not hold, custody, safeguard, or maintain deposits of user money, and is not a bank, money transmitter, e-money institution, payment custodian, or fiduciary with respect to your funds. When you add funds, you are purchasing non-refundable, non-withdrawable on-platform credit ("Cash") that may be used solely to enter cash matches on the Platform. Cash is not money, holds no cash value, is not redeemable or exchangeable for cash, cannot be withdrawn or transferred, and is non-refundable except where a refund is required by applicable law or arises from a genuine duplicate charge caused by a system error. Only Withdrawable Cash obtained by winning cash matches may be withdrawn, subject to Sections 8 and 9.

Deposits are processed via Stripe, Inc. (including Apple Pay and card) using fiat currency (USD) only. By depositing, you also agree to Stripe's Terms (stripe.com/legal) and Privacy Policy (stripe.com/privacy). We do not receive or store your full payment-card details; all card data is handled exclusively by Stripe. The minimum deposit is USD 1.00 and the maximum is USD 10,000.00 per transaction; we may impose additional per-user or per-period limits at our discretion, and large or rapid deposits may trigger a security review. Deposits are final and non-refundable once credited, except as required by applicable law or in the case of a genuine duplicate charge caused by a system error.

If you believe a charge is erroneous, contact us first at team@conquestarcade.com. Initiating a chargeback or payment dispute without first contacting Conquest support will result in immediate account termination, permanent ban from the Platform, and forfeiture of all balances and pending winnings. We reserve the right to refuse, hold, or reverse deposits we suspect are fraudulent, associated with money laundering, or in violation of these Terms.

8. Identity Verification (KYC)

Before your first withdrawal, you must complete a one-time identity verification ("KYC") processed by Stripe Identity. Verification may require a government-issued photo ID, a selfie, your date of birth, and proof of address, and supports our legal, anti-money-laundering, and anti-fraud obligations. You may make a limited number of verification attempts; repeated failures may temporarily lock verification, in which case you should contact Customer Support (in the App under Settings). We may require re-verification or additional documentation (such as an IRS Form W-9 or W-8BEN) before processing a payout, and the name on your payout account must match your verified identity or we may decline the payout.

9. Withdrawals & Payouts

Only your Withdrawable Cash balance is eligible for payout. Withdrawals are reviewed and paid manually by our operations team and are not instant. You may withdraw via PayPal, Wise, or bank transfer (SWIFT / ACH / Wire), subject to:

(a) completion of identity verification (KYC) through Stripe Identity;

(b) no active payment disputes, chargebacks, or bank inquiries on any prior deposit;

(d) the name on the payout account matching your KYC name (minor variations excepted at our discretion).

Withdrawals are processed manually, typically within 24–48 hours. First-time withdrawals and withdrawals requested shortly after a deposit may be subject to additional security review and holding periods. A limited number of withdrawal requests may be pending at once, and per-request limits apply. We reserve the right to hold, delay, or deny any withdrawal where we detect behavior consistent with fraud, money laundering, or abuse — including depositing funds and immediately requesting a withdrawal without meaningful competitive play — and to request additional information before paying. We may deduct or offset amounts to recover chargebacks, reversed deposits, or amounts owed to us.

Tax reporting and information returns. Conquest Labs LLC may be required to report withdrawal payments to the U.S. Internal Revenue Service (IRS) and applicable state tax authorities. By requesting a withdrawal, you agree to provide a complete and accurate IRS Form W-9 (for U.S. persons) or Form W-8BEN / W-8BEN-E (for non-U.S. persons), including a valid taxpayer identification number, upon request. If your aggregate withdrawals in any calendar year meet or exceed the applicable IRS reporting threshold (currently USD 600), we may issue you a Form 1099 (or other applicable information return) and file a copy with the IRS. We may apply backup withholding where required by law. You are solely responsible for the accuracy of the tax information you provide and for reporting and paying any taxes on amounts you receive. We do not provide tax advice and recommend you consult a qualified tax advisor.

10. Free Practice Mode

Games are playable in free Practice mode with no entry fee and no stake. Practice mode is available regardless of age eligibility for paid play or location, and users who are not eligible for paid matches are encouraged to use Practice mode only. Practice mode has no real-money component and awards no Cash or Gems.

11. Responsible Gaming

We are committed to responsible play. We encourage every player to set personal spending limits, take regular breaks, never play with money they cannot afford to lose, and never chase losses. To voluntarily restrict your access to paid features, email team@conquestarcade.com with the subject line "Self-Exclusion Request"; we will process such requests promptly. If you or someone you know may have a gambling problem, help is available from the National Problem Gambling Helpline (USA) at 1-800-522-4700 (call or text) or ncpgambling.org, and from Gamblers Anonymous at gamblersanonymous.org.

12. Prohibited Conduct

You agree not to engage in any of the following. Violations may result in immediate account termination, forfeiture of your entire Gem, Cash, and Withdrawable Cash balances, and potential legal action:

Using bots, scripts, macros, automation tools, or any non-human or unauthorized method to interact with the Platform or gain an unfair advantage.
Creating or operating multiple accounts (multi-accounting) or manipulating matchmaking, ratings, or prize pools.
Colluding with other players to fix or influence match outcomes.
Engaging in fraud, money laundering, or misrepresenting your identity, age, location, or payment information.
Exploiting bugs, glitches, or errors. You must report any discovered bug to team@conquestarcade.com immediately.
Initiating chargebacks or payment disputes without first contacting Conquest support. Chargebacks filed without prior contact will result in immediate termination, permanent ban, and forfeiture of all balances.
Depositing funds and immediately withdrawing without meaningful competitive play.
Using payment instruments not registered in your own name.
Using VPNs, proxies, or location-spoofing tools to mask your location or circumvent geographic restrictions.
Attempting to reverse-engineer, decompile, or circumvent the Platform's security or server-side logic.
Sharing, selling, or transferring your account, or using the Platform in violation of any law.

13. Match Recordings & User Content

The App may record your gameplay screen during competitive matches and upload the recording to our secure cloud storage for match review and anti-cheat analysis; Practice matches are not recorded. You grant Conquest a worldwide, royalty-free, non-exclusive license to store, process, and use your match recordings and any content you submit (such as a profile photo or display name) for match adjudication, customer support, anti-cheat, safety, and operating the App. Match recordings are not shared publicly and are automatically deleted after approximately 30 days. You are responsible for content you submit and must not upload anything unlawful, infringing, or that you lack the right to share; we may remove content and act on your account for violations.

14. Intellectual Property

Conquest Arcade and its underlying technology, software, design, game graphics, audio, trademarks, and branding are owned by Conquest Labs LLC or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment in accordance with these Terms. You may not copy, reproduce, distribute, modify, create derivative works of, or commercially exploit any part of the App without our prior written consent. Your use of the Platform grants you no license to use any Conquest intellectual property beyond what is strictly necessary to use the Platform as intended.

15. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CONQUEST DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES, OR THAT ANY MATCH RESULT WILL BE AS EXPECTED. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CONQUEST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, GEMS, OR CASH, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL CONQUEST'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM EXCEED THE TOTAL AMOUNT YOU PAID TO CONQUEST DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE CLAIM.

17. Indemnification

You agree to defend, indemnify, and hold harmless Conquest Labs LLC and its respective officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Platform; (c) your violation of any third-party rights, including intellectual property rights; or (d) your violation of any applicable laws or regulations.

18. Dispute Resolution

These Terms and any disputes arising out of or related to your use of the Platform shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions.

PLEASE READ THE FOLLOWING CAREFULLY. IT AFFECTS YOUR RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved exclusively through final and binding individual arbitration, rather than in court. You waive your right to participate in any class action lawsuit or class-wide arbitration. The arbitration shall be conducted by a single arbitrator in accordance with the rules of a recognized arbitration body, and judgment on the award may be entered in any court of competent jurisdiction. If for any reason a dispute proceeds in court, you and Conquest irrevocably submit to the exclusive jurisdiction of the state and federal courts located in Delaware.

Before initiating arbitration, the parties agree to attempt in good faith to resolve the dispute informally by contacting team@conquestarcade.com. Notwithstanding the above, Conquest may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

19. Suspension, Termination & Forfeiture

Conquest reserves the right to suspend or permanently terminate your account, at our sole discretion and without prior notice, for any violation of these Terms or for any conduct we determine to be harmful to the Platform, other users, or our business. Upon termination for cause — including chargebacks filed without prior support contact, fraud, multi-accounting, money laundering, cheating, or circumvention of security controls — you forfeit any remaining Gem, Cash, and Withdrawable Cash balances without compensation, and we may retain forfeited balances to offset chargeback fees, dispute costs, and regulatory penalties. Provisions of these Terms that by their nature should survive termination will continue to apply after termination.

20. Account Deletion & Data Retention

You may delete your account at any time from within the App (Profile → Delete Profile). On deletion, you can no longer sign in, and your personally identifying information (such as country, push identifiers, and profile photo) is removed from the live App. You irrevocably forfeit all balances at the moment of deletion — Gems, Cash, and Withdrawable Cash — and we owe no refund; any active player-versus-player match is treated as a forfeit (a loss).

Because Conquest is a regulated real-money service, certain records are retained as required by law — including U.S. tax reporting (e.g., 1099 issuance), anti-money-laundering and Bank Secrecy Act obligations, state skill-contest regulations, and payment-dispute windows. Retained records may include match outcomes (with your name shown to others as "Deleted User"), deposit and withdrawal history, the cash ledger, support tickets, and gameplay statistics. This retention approach is permitted under Apple App Store Guideline 5.1.1(v) for regulated industries. To request deletion of data beyond the legal-retention floor, email team@conquestarcade.com with the subject line "Data Deletion Request"; we will respond within 30 days. Personal data is otherwise handled in accordance with our Privacy Policy.

21. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you within the App or by email, and we may require re-acceptance. Your continued use of the Platform after any changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

22. Apple & Platform Providers

These Terms are between you and Conquest Labs LLC only, and not with Apple Inc. or any other app-store or platform provider ("Platform Provider"). Apple is not a sponsor of, and is not involved in, any real-money contest, match, or prize offered through the App. The Platform Provider has no obligation to furnish maintenance or support for the App and is not responsible for the App, its content, or any claims relating to it (including product-liability, legal-compliance, or consumer-protection claims). You must comply with the applicable app-store terms of service. The Platform Provider and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
